These terms govern the booking and participation in the activities of Sunrise Paddle Surf Barcelona. By booking, purchasing or taking part in any of our activities, you accept these terms.

1. Website owner (Legal notice)

In compliance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), the owner's details are provided below:

Hereinafter, "Sunrise Paddle Surf Barcelona", "the school" or "we" refer to the owner; "you", "the client" or "the participant" refer to the person who books or takes part in an activity.

2. Purpose and acceptance

These terms govern the relationship between the school and the client for the booking and enjoyment of sunrise and sunset paddle surf tours and lessons, private sessions, SUP yoga and group experiences offered on this website.

By booking, paying or clicking the acceptance button, you declare that you have read, understood and accepted these terms. In addition, the person who pays or clicks the acceptance button warrants and is responsible for ensuring that all other people included in the booking (companions, group, family members or guests) have likewise read and accepted these terms and conditions, including the declarations in section 7 and the clauses on minors in section 9. In the case of minors, the terms have been read and accepted on their behalf by their parent or legal guardian.

3. Bookings and confirmation

Paddle surf, SUP yoga and private sessions are usually available throughout the year. As this is an activity at sea, each session depends on the conditions of the day.

4. Prices and payments

Prices are shown in euros and include applicable taxes where relevant. Payment is made securely through our payment gateway (Stripe).

5. Private sessions and groups

Private sessions accommodate a variable number of people, with a price per group indicated in each case according to the number of participants. Group activities and events (stag and hen parties, team building, families) are tailored to the group and may be arranged via WhatsApp. These spots are reserved exclusively for your group.

6. Cancellations, changes and refunds

If we cancel (unsuitable conditions, unfavourable sea state or force majeure): we offer to reschedule the activity to another date or, if you prefer, a refund of the amount for that activity. We are not responsible for the client's incidental expenses (travel, accommodation or others).

If you cancel or want to change: you must notify us at least 48 hours in advance to reschedule your spot at no cost. Cancellations with less notice, as well as no-shows, do not give the right to a refund or to reschedule, as these are spots reserved exclusively and activities subject to availability.

Late arrivals: the activity is not extended due to the client's late arrival; you may join if possible without affecting the group.

Right of withdrawal: in accordance with article 103.l) of the consolidated text of the General Law for the Protection of Consumers and Users (Royal Legislative Decree 1/2007), services related to leisure and recreational activities provided on a specific date or period are excluded from the 14-day right of withdrawal. Therefore, once an activity has been booked for a specific date, the right of withdrawal does not apply, without prejudice to the change policy set out above.

Approved refunds are issued to the same payment method used for the purchase.

7. Participation and safety requirements (swimming ability)

Being able to swim in open water is an essential requirement. By accepting these terms, the person making the booking expressly declares, under their own responsibility, that:

The participant must inform the school of any relevant circumstance (injuries, ailments, allergies, pregnancy, etc.) before the activity. It is mandatory to follow the instructor's instructions and the safety rules at all times. For safety reasons, the instructor may limit, suspend or not authorise the participation of anyone who is not fit or does not follow the guidance, without this giving rise to any right to a refund.

Any inaccuracy or falsehood in these declarations releases the school from all responsibility for the consequences arising from it.

8. Assumption of risk and liability

Paddle surf and SUP yoga are activities carried out in the marine environment and involve an inherent risk. The participant (or their legal guardian, in the case of minors) is aware of and voluntarily assumes the risks inherent to these activities in the water.

Sunrise Paddle Surf Barcelona holds civil liability and accident insurance for the practice of the activity. However, the school is not responsible for:

To the extent permitted by applicable law, the school's liability is limited to the amount of the activity booked. Nothing in these terms excludes or limits liabilities that the law does not permit to be excluded, nor the rights granted to you as a consumer under current legislation.

9. Minors

The enrolment of minors is carried out and authorised by their parent or legal guardian, who accepts these terms on their behalf, declares the relevant medical details and the aptitude and swimming ability of each minor (section 7), and authorises their participation.

The person making the booking and including one or more minors declares that they are the legal guardian or that they have the express authorisation of the guardians, that they have informed them of the characteristics and risks of the activity, and that they assume full responsibility for the minors before, during and after the activity, holding the school harmless against any claim related to their participation.

10. Image rights

During the activities we may take photographs and videos for educational and promotional purposes for the school (website and social media). By taking part, you consent to this use. If you do not wish this, please notify us in writing at supsunrisebarcelona@gmail.com and we will respect it, removing as far as possible any content in which you appear. In the case of minors, this consent is granted or denied by their legal guardian.

11. Intellectual and industrial property

All the contents of this website (texts, photographs, designs, logos, icons, trademarks, source code and other elements) are the property of Sunrise Paddle Surf Barcelona or of third parties who have authorised their use, and are protected by intellectual and industrial property legislation. Their reproduction, copying, distribution, transformation or public communication without the express written authorisation of the owner is prohibited.

12. Use of the website

The user undertakes to make appropriate use of the site and not to use it for unlawful purposes, nor to introduce viruses or harmful code. Failure to comply with these terms may result in the cancellation of the service.

13. Data protection

The processing of your personal data is governed by our Privacy Policy, which forms part of these terms.

14. Changes to the terms

Sunrise Paddle Surf Barcelona may update these terms to adapt them to legal changes or changes to its services. The version published on this page at the time of booking will apply. We recommend reviewing it periodically.

15. Applicable law and jurisdiction

These terms are governed by Spanish law. For disputes with consumers, the courts and tribunals determined by law shall have jurisdiction; as a general rule and for clients who do not have consumer status, the parties submit to the courts and tribunals of Barcelona. If you are a consumer, you may also use the European Union's online dispute resolution platform.
